Terms of Service
1. Agreement
These Terms of Service ("Terms") govern your access to and use of Autosales Agent ("Service"), including our website, web application, AI-assisted outreach tools, and related services operated by Autosales Agent from India ("we," "us," or "our"). By creating an account, starting a trial, or using the Service, you agree to these Terms.
If you use the Service on behalf of a company, you represent that you have authority to bind that company, and "you" refers to that entity.
2. The Service
Autosales Agent is a software-as-a-service platform that helps you configure sales outreach agents using your business website, buyer signals, keywords, and connected channels such as LinkedIn. Features may include lead discovery, message drafting, campaign management, analytics, and billing through our payment partners.
We may update, improve, or discontinue features at any time. We will use reasonable efforts to avoid material disruption to paid subscriptions.
3. Accounts and eligibility
You must be at least 18 years old and capable of entering a binding contract. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@autosaleshq.com if you suspect unauthorized access.
You agree to provide accurate registration information and keep it current.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, deceptive, harassing, or spam activity.
- Violate LinkedIn, email, or other third-party platform terms when connecting accounts or sending outreach.
- Scrape, reverse engineer, or attempt to bypass security or rate limits except as permitted by law.
- Upload malware, interfere with the Service, or access another user's data without permission.
- Misrepresent your identity or impersonate others in outreach messages.
We may suspend or terminate accounts that violate these rules or pose risk to the Service or other users.
5. Your content and data
You retain ownership of content you submit (website URLs, business profiles, campaign settings, messages, and similar data). You grant us a limited license to host, process, and display that content solely to operate and improve the Service, including AI-assisted features you enable.
You are responsible for ensuring you have rights to use any content you provide and that your outreach complies with applicable laws, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (India), and other laws that apply to you or your recipients (including GDPR or similar laws for international users).
6. AI-generated output
The Service may generate suggested signals, keywords, messages, or other outputs using automated systems. AI output may be inaccurate or incomplete. You are responsible for reviewing and approving outreach before it is sent. We do not guarantee results, reply rates, meetings booked, or revenue outcomes.
7. Subscriptions, billing, and trials
Paid plans, trials, and renewals are processed through our payment provider (e.g., Polar or Stripe). By subscribing, you authorize recurring charges according to the plan you select until you cancel.
Prices, features, and plan limits are shown at checkout or on our pricing page. Applicable taxes (including GST in India, where required) may be added as required by law. Failed payments may result in suspension until resolved.
Free trials convert to paid subscriptions unless canceled before the trial ends. Trial eligibility and duration are described at signup.
8. Refunds
Refund terms are described in our Refund Policy, which is incorporated into these Terms by reference.
9. Privacy
Our Privacy Policy explains how we collect, use, and protect personal data. We do not sell your personal data.
10. Third-party services
The Service integrates with third parties (e.g., Google sign-in, LinkedIn, payment processors, hosting, and analytics). Your use of those services is subject to their terms. We are not responsible for third-party outages or policy changes.
11. Intellectual property
We and our licensors own the Service, software, branding, documentation, and all related intellectual property except your content. You may not copy, modify, or create derivative works of the Service except as allowed by these Terms or written permission.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Autosales Agent AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ₹10,000 (Indian Rupees).
14. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
15. Termination
You may cancel your subscription or delete your account at any time through the Service or by contacting us. We may suspend or terminate access for breach of these Terms, non-payment, or legal requirement. Upon termination, your right to use the Service ends; sections that by nature should survive (payment obligations, disclaimers, limits of liability, and dispute terms) will survive.
16. Changes to these Terms
We may update these Terms from time to time. We will post the revised version on this page and update the effective date. Material changes may be notified by email or in-app notice. Continued use after changes become effective constitutes acceptance.
17. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country apply.
Any dispute arising out of or relating to these Terms or the Service shall first be raised with us at hello@autosaleshq.com so we can attempt good-faith resolution within thirty (30) days.
If the dispute is not resolved, it shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
